A surveyor selected by the two party wall surveyors appointed in relation to a particular party wall dispute and authorised to resolve any disagreement or issues referred to him or her by the appointed surveyors or by their appointing owners.
In appropriate circumstances the third surveyor can make and issue party wall awards in respect of the subject matter of a party wall dispute and any such awards are subject to the same rights of appeal as any other party wall award. Should a party wall appeal be required against a party wall award it is important to act quickly and to consult an experienced party wall solicitor as there is a very limited time allowed under the Party Wall etc. Act 1996 for such appeals to be lodged.
Child & Child have a number of specialist party wall solicitors with wide experience of court proceedings involving party wall disputes, from numerous trials of domestic party wall disputes in the county court to complex cases involving trials in the Chancery Division of the High Court and appeals to the Court of Appeal.
